How The Buying Process Work

  1. Sign Buyers Agency Agreement at the beginning of your first meeting with your Realtor.

  2. Sign Buyer Representation Agreement.

  3. Be Columbo - Check out all cost and expenses before you sign.

    Make sure all utilities (gas, electricity, and water) are on during your walk-through so you can inspect everything in working order. Ask lots of questions and be very detail conscious.

  4. Contact a lender to get a Pre-Approved loan - please note the difference between getting pre-qualified VS getting pre-approved. A pre-qualification is merely a lender telling you how much your note would be based on how much you make VS how much you owe monthly. It is very important to having a smooth transaction to have a completely approved loan except for a purchase agreement, and an appraisal.

  5. Decide your home criteria-The purchase price, area, size etc

  6. Schedule an appointment with your Realtor-Set a convenient time to look for a home with your Realtor.

  7. Negotiate purchase agreement - Once you find the home you are interested in purchasing, your Buyer's Agent will assist you with a strategy to negotiate the purchase agreement price, who pays closing cost, inspection report time limit, closing date, closing Escrow Company, occupancy time, contingencies. If satisfactory, Buyer signs contract and gives the Buyer's Agent a personal check for 3% of the purchase price as a deposit toward the purchase price of the home.   8. The check is submitted with a written offer to the home seller with a pre-approval letter and proof of funds.

  9. If the offer is not accepted by Seller or the mortgage can not be obtained then all fund will be returned to Buyer.

  10. When the offer is accepted the buyer begins making sure all inspections; contingency removal and contractual obligation are met.

  11. Schedule inspection of property by professional of your choice, this should be done as soon as there is an accepted offer. Beware that some inspectors will give you a very detailed report. Don't be scared by this, it is the inspectors job to point out every possible thing that is not new or in the same condition it was when it was new. There are no perfect homes, not even a new home.

  12. Give written report to seller-requesting desired repairs to be made by seller.

  13. Realtor orders Appraisal-Your Realtor should have a team of competent vendors and will gladly recommend a professional appraiser. The appraisal should be ordered within one day of the satisfactory inspection report.

  14. Realtor contacts closing Escrow company-and purchase agreement is faxed, and time of closing is schedule as per buyer and sellers request.

  15. Walk through inspection is scheduled-this is usually scheduled the day before closing, particularly if there are seller repairs to be made.

  16. Closing is scheduled- Congratulation!! This is the grand finale, you get the keys to your new home. Be sure to get your homeowners insurance in advance, you will also need your driver license at the closing. You will need a cashiers check for your down payment. Your lender or Escrow will be able to give you a close estimate as to how much you will need.

Agency Agreement

Whenever a home buyer enter into a discussion with a real estate agent regarding a real estate transaction, the buyer should from the outset understand what type of agency relationship or representation the buyer wish to have with the agent in the transaction.

As of January 1, 1988, for every residential property transaction of one to four units, the law requires that an agent supply a written document, called Agency Disclosure, explaining the nature of agency to a seller before listing a property, or to a buyer before writing an offer.
